Father and son pay £3,000 for fly tip

Father and son pay £3,000 for fly tip

John Joseph Mongan, 44, and James Christopher Mongan, 18, both of Colne Park Caravan Site, Cricket Field Road, West Drayton, Middlesex, were convicted at Milton Keynes Magistrates Court on 14 July 2017 for a fly tipping offence, after both pleading guilty.

The Court heard that in November 2016 a building company carried out a bathroom re-fit at an address in Ashford, Middlesex.  The waste generated by the building work included a bath, a toilet, a washbasin, ceramic tiles, cardboard packaging, plastic bin sacks, plasterboard, plumbing waste, builder's bags and wood. On the morning of 2 December 2016 the builders contacted John Mongan, who they had used before, to arrange the removal of the waste. John and James Mongan removed the waste later in the morning for an agreed price of £180.

On 7 December 2016 a Thames Valley Police Officer went to a fly tipped site at Mansion Lane, Iver, Buckinghamshire. Packaging labels found within the dumped waste were traced to the Ashford address and evidence was gained from the householder and the builders.

John and James Mongan were interviewed at a police station and made full admissions to the dumping. John Mongan stated that he was doing his son a favour by driving, as James was not insured to drive the tipper truck used in the removal job. James said it was his job and that they went straight from the Ashford address and illegally dumped the waste at Mansion Lane.

The Magistrates fined John and James Mongan £550 each and ordered them to pay £938 each towards prosecution costs, plus £55 each in victim surcharge. The total each person had to pay was therefore £1,543, with a combined figure of £3,086.

The case was investigated and prosecuted by Buckinghamshire County Council working on behalf of the Waste Partnership for Buckinghamshire. The Waste Partnership launched the 'Illegal Dumping Costs' campaign in November 2003 to combat illegal dumping and waste management offences in Buckinghamshire. Since that date the Partnership has secured over 600 convictions against individuals and companies for illegal dumping and related offences. This has resulted in a significant saving to the Buckinghamshire taxpayer over the period, principally through reduced removal and disposal costs.
