Smokefree workplaces

All workplaces and enclosed public areas in England are 'smokefree'. 

This includes offices (including smoking rooms), factories, shops, pubs, bars, restaurants, membership clubs, public transport and work vehicles that are used by more than one person.

Smokefree legislation is only concerned with smoking tobacco and other 'lit' materials, that is to say, when combustion or burning is taking place. For this reason, it is not an offence to use e-cigarettes in enclosed workplaces and public places.

However, Action on Smoking and Health (ASH) and The Chartered Institute for Environmental Health (CIEH) have recognised that businesses may need to decide whether to permit or prohibit e-cigarette use on their premises and have produced the following guidance to help :
